General Terms and Conditions OF SALE (GTCS)

  • The following terms have been agreed between the buyer, hereinafter referred to as the “Client”, and the company “PEAK XV TRADE”, hereinafter referred to as the “Company”.
  • These general terms and conditions of sale (hereinafter:GTCS) apply to products that our Company sells (“Products”) and apply to Client i.e individual or legal entities, who uses or resell the products in the framework of their professional activity.
  • Any order accepted by our Company with effect from the date stated above is governed by these terms and conditions.

The acceptance of an order requires written confirmation from our Company.

  • If the order is placed by contacting directly our sales team, the Client will be notified and asked for their final order confirmation.
  • If the order is placed online via our site and the full payment has been made using one of our certified payment gateway, the Client here agrees to have confirmed their purchase order. The Client will also be notified via email about their order and once the payment is received by our Company.
  • In the absence of an objection by the Client within a period of 24 hours, the terms indicated in this confirmation will be deemed to have been accepted by the latter. The client then cannot cancel the order for the customized Products or an order already shipped.
  • Our company has full right to change the product price without prior notice to Clients.
  • There won’t be any change in the product price, once the order is accepted by our Company.
  • For any client except with whom our Company has agreed in the special terms and conditions, the payments must be made at the time of order.
  • The products will not be delivered until the full payment including product price, delivery charges & tax has been paid by the Client.
  • Our company use certified payment gateway available in Nepal for online sales. We do not handle online transaction and therefore, we are not responsible for any loss or theft of personal bank details of the Client.
  • There might be a case, where your account is already debited after online purchase, and we might not receive the payment. Your order will be in hold and will not be delivered until we receive the full payment.
  • The Client will be informed in advance via email or telephone about the delivery time and date by the Company.
  • Paid Delivery Case-In any case, if the Client is absent during the agreed delivery time and date in their mentioned address, the Client will have to pay again for the next delivery.
  • Free Delivery Case– it is only validated one time. If the Client is unable to receive the product in the agreed delivery date and time, the Client has to contact our sales team to fix the next date. In this case, the Client will have to pay the delivery charges.

Absence Case-

  • If the Client is absent/unable and want someone other to receive the product on their behalf at the agreed delivery date and time, the Client must send us a written confirmation in advance at least 1 hour before. The company will not be responsible for any loss or damage made to the product thereafter.
  • If the Client do not contact and send us a written confirmation in advance, the product will not be delivered to any random person like friends or neighbours. In this case, the above-mentioned delivery conditions will be applied.
  • Our company will not be responsible for any delay in delivery caused due to uncertain problems like strike, weather conditions or anything that is beyond our control. The client will be informed in advance of any delay in delivery. The Company will provide you delivery services without any extra cost, if the delay is made due to our operational reason.
  • Our Company will only provide delivery, at no extra cost, if the client is absent and unable to contact us due to a valid reason. This has to be accepted by the Company.
  • Our Company will be responsible for any damage made to the product during the delivery process before handing it over to the Client.
  • Once the product is delivered and confirmed by the Client, our Company will not be responsible for any damage or loss thereafter.
  • The Client here agrees to have the knowledge of the product purchased. Our company will not be responsible for any accident occurred due to the wrong use of the products.
  • There won’t be any refund once the product is purchased.
  • In the event of damage or missing of any parts of the product, the Client must contact our sales team within 24 hours. The product will be exchanged. The product should be in its original packaging.
  • Any claim made after 24 hours will not be accepted by our Company.
  • The Product Guarantee only applies to parts and labour only, and covers defects in materials or workmanship.

The following are excluded from the guarantee:

  • Batteries, normal wear and tear, corrosion of the Product, any inappropriate use or maintenance of the Product and any negligence. Further details are available on Petzl.com

The Client and Company both agrees to face the supreme court or the concerned authorities, if the above-mentioned terms and conditions are violated.
